The labor protection certificate consists of a thick cover, into which a special form is pasted, containing all the necessary information. The first page displays the following information:

  • full name of the organization that conducted the training of the employee;
  • last name, first name and patronymic of the employee to whom the certificate was issued;
  • the position currently held by the person taking the course;
  • training program and number of hours;
  • the number and date of the minutes of the meeting of the commission that decided on the results of the knowledge test;
  • surname, name and patronymic, as well as the signature of the chairman of the commission;
  • organization seal.

The second page contains information about re-testing knowledge of labor protection rules.

It should be noted that a certificate that does not contain the signature of the chairman of the commission and the seal of the training center is invalid. Therefore, upon receipt, you need to check the filling of all fields.

Why and in what cases is a certificate required?

According to Article 225 of the Labor Code of the Russian Federation, all employees, including heads of organizations, as well as employers - individual entrepreneurs, are required to undergo labor protection training.

This obligation means that each employee must undergo all types of briefings with entries in a special journal. The knowledge gained helps to avoid death and injury at work.

For many professions and positions, the organization of special training with the subsequent issuance of a certificate is required, since they have a special responsibility in the field of ensuring the safety of the work process.

The list of positions for which a mandatory requirement is the presence of such a certificate is very extensive:

  • heads of organizations and enterprises;
  • deputy heads;
  • department heads;
  • engineers;
  • any category of employers;
  • teachers teaching labor protection and life safety;
  • industrial practice leaders;
  • persons responsible for safety;
  • persons who are members of commissions investigating accidents at work;
  • specialists of executive authorities;
  • and so on.

Registration of a certificate of knowledge of labor protection requirements

Registration is undertaken by special training centers that have a license for the right to engage in educational activities. Moscow holds the record for the number of educational institutions, but not all of them offer quality services.

The formalization stage begins after the listener completes the training course and confirms his knowledge gained during the lecture period.

The document is drawn up in accordance with the requirements and includes information about the employee, as well as the training program completed. At the final stage, the signature of the chairman of the commission and the seal of the organization are affixed, confirming the authenticity of the certificate.

The procedure for training and testing knowledge on labor protection

The requirements for testing knowledge of labor protection, as well as the training procedure, are regulated by the Decree of the Ministry of Labor of the Russian Federation and the Ministry of Education of the Russian Federation of January 13, 2003 N 1/29.

To obtain the relevant document, you must contact the training center and apply for training. The training process is built using seminars, consultations and business games. Training is carried out according to the developed and approved program.

Certificate validity period

The work safety certificate is valid for three years. The duration of full-time training is about two weeks. Upon its completion, a knowledge test and the subsequent issuance of a “crust” are organized.

In this regard, the legislation (Article 217, part 1 of the Labor Code of the Russian Federation, clause 3.1.1 of the Standards for the number of employees, Letter of the Ministry of Labor of September 28, 2017) has a certain regulation.

  • Less than 50 employees - the functions are performed by a specialist appointed to the position / part-time, the employer himself.
  • Up to 700 units in the state - a separate specialist works.
  • Up to 700 employees in hazardous or harmful production - service.
  • Over 700 employees - a bureau (3, 4, 5 people) or a labor protection service (more than 6 staff units) is required.

Officials conduct briefings, draw up a plan, fill out a journal, and maintain reporting documentation. They are in charge of observing safety rules in the workplace, participating in measures to prevent accidents at work. Some enterprises, which is quite legal (Article 212 Part 1 of the Labor Code of the Russian Federation), hire third-party, freelance specialists, concluding a civil labor contract with them, but this is an additional expense item.

How is a labor protection specialist hired and inducted

Who needs an occupational health and safety certificate

According to Article 212 of the Labor Code of the Russian Federation, the head of the enterprise does not have the right to allow employees to work who have not been properly trained and have not passed introductory and primary briefings, internships and knowledge testing on labor protection, and have not received an appropriate labor protection certificate. The responsibility for the implementation of all these activities lies directly with the head of the enterprise, as well as with a specialist (engineer) in labor protection. In case of non-fulfillment or improper fulfillment of the above legislation, liability is provided on the part of officials and the enterprise. This may be the imposition of an administrative fine or the suspension of the economic activities of the organization for up to 90 days (Article 5.27 of the Code of Administrative Offenses of the Russian Federation). Training of personnel in the basics of labor protection can be carried out at the enterprise with or without interruption from work, or at a specialized training center that has all the necessary licenses and permits.

  • persons who are responsible for the organization, management, control and technical supervision of the safe performance of work in the workplace,
  • heads and engineers of labor protection services, as well as persons who are entrusted with the duties of a labor protection specialist,
  • chairmen and members of commissions of enterprises that test knowledge of labor protection requirements,
  • heads and specialists of organizations that provide certain services in the field of labor protection to other organizations.

Training in labor protection issues is carried out in various forms and according to various programs approved by the organization that conducts the training. Programs are subject to review every three years.

Persons who have completed the training and successfully passed the test of knowledge of labor protection requirements receive an appropriate certificate of labor protection.

Registration of a certificate form for testing knowledge of labor protection requirements

The form and form of the labor protection certificate are established by law.

A blank certificate of labor protection has the form of a booklet of two pages in a hard cover of red or burgundy color with golden embossing.

On the first page of the crust on labor protection it is indicated:

A labor protection certificate that is not signed by the chairman of the commission and not certified by the seal of the training organization is invalid.

Persons who have been trained in specialized centers and have an appropriate labor protection certificate can independently instruct the personnel of the enterprise.

Training of employees of the enterprise is carried out immediately after hiring and directly at the workplace by foremen (heads) of sections and teams.

At the enterprise, a commission must be created to test the knowledge of labor protection requirements, consisting of at least three people. All results are documented in an appropriate protocol. Persons who pass the test are issued certificates. The next inspection is carried out at least once every three years.

Issuance of labor protection certificates



According to existing regulations*, specialized training centers that have a license and accreditation in the field of Labor Protection (Article 217 **, clause 2.3. be a fairly large organization, the creation of its own commission is a very laborious task, and discussion is not for this article).

We propose to solve this problem in two ways:

  • 1. Issue a certificate of verification of knowledge of labor protection requirements on the job, while the employee can not be interrupted from production duties. This option is suitable ONLY for specialists who have been trained before and have considerable experience behind them. We recommend the second option for beginners.
  • 2. With a direct visit to the training center. The process is over long (40 hours - about a month), but the specialist will receive all the necessary knowledge that he may need in the course of work.
    At the end of the training, he will pass the exam (in the form of a test), receive a "crust", and will be able to begin to perform his immediate duties.

Validity period of the labor protection certificate



The term established for the certificate (crust) on labor protection is prescribed in Decree 1/29 * (the main standard on the basis of which the article was written). Specialists must confirm their qualifications at least once every 3 years (clause 2.3.1 *).

But there are nuances - a representative of the controlling authorities has the right to demand a re-check, regardless of the deadline for passing (even if the employee received the documents yesterday), so it is recommended that you still know the theory.

When is an audit required?

The next checks are described in more detail in clause 3.3*.
  • 1. When changing regulations, legislative norms, other standards;
  • 2. With changes in technical processes, operation of new equipment, in other cases, when employees are required to obtain additional knowledge to ensure safe work;
  • 3. Appointment of a specialist to a new position;
  • 4. At the request of the inspector (upon detection of violations, accidents, etc.);
  • 5. A break in work for more than a year.
In addition, when moving from one organization to another, the certificate loses its validity and must be reissued. The employer must take care of obtaining this document for a newly hired employee within a month after hiring (clause 2.3.1 *).

What is a certificate (attestation) for labor protection



And now some theory.

Certificate - there is nothing more than a document confirming that the owner has the right to a particular type of activity (in the common people "crust").

Labor protection - a set of measures aimed at providing the organization with safe working conditions.

It follows that a labor protection certificate is a document confirming that the owner can (has the right) to take a direct part in ensuring the safety of his enterprise.

According to clause 1.5 *, all management personnel must be certified in this area. Of course, in practice this is usually not done, but the person responsible for labor protection and the manager are required to receive this document (if there is no responsible person in the organization, then the head of the enterprise, clause 1.7 *, takes responsibility).

This document is issued by specialized educational institutions licensed and accredited in this field.
Training programs are developed and approved by the Ministry of Labor and Social Development of the Russian Federation in agreement with the Ministry of Education of the Russian Federation.
The head of the enterprise is responsible for the correct and timely execution of certificates (crusts) for his specialists (clause 1.7*).

Workers are often interested in how they can check their labor protection certificate.

For us, this is a strange question, for one simple reason - if it arose, then where did you receive it? Of course, there are a lot of dubious organizations in this area now, and prices sometimes do not correspond to reality (which is also important to pay attention to), and humanly these people can be understood.

As is customary in our 21st century, training centers do not publish information about certification (although in vain), you have to check it the old fashioned way. If you do not like OUR offer, then below are a few aspects that you need to pay attention to.

  • 1. Any employer has the right to send a request to an educational institution for an employee to pass certification, and he is obliged to respond as soon as possible (some, like ours, for example, even confirm by phone);
  • 2. In practice, the question arose whether it was necessary to undergo an audit if an employee was trained in labor protection standards while in one position, and then was transferred to another. After all, the certificate indicates the position and place of work. How to be in this situation? Do I need to re-test my knowledge and issue a new certificate? We believe not. Taking into account the provisions of the Decree, including the requirements for conducting extraordinary inspections, it can be concluded that when changing a position, an extraordinary inspection should be carried out only if additional knowledge of labor protection standards is required to work in a new position. If the knowledge of labor protection available and confirmed by the certificate is sufficient, then additional checks are not required.

Issuance of a labor protection certificate

When issuing a certificate, a question may arise about the seal, which certifies the signature of an authorized person (according to clause 3.7 of the Procedure, the certificate is signed by the chairman of the commission). If the company does not have a seal (and in 2016 the rule on the mandatory presence of a seal has ceased to be mandatory), then, accordingly, a seal is not required. If the company seals (seal) are used, then the signature is certified by the seal (if there are several), which the company determines in its local acts. For example, these can be stamps “For documents”, “For office work”, etc. If training and knowledge testing was carried out by a third-party training organization, then the issue of printing is resolved in accordance with its internal procedures.
