A responsible approach to labor protection in enterprises is the cornerstone of successful production activities. Employees trained in the basics of occupational safety can safely perform their duties. The absence of injuries and, as a result, sick leave increases the company’s performance. Certificate of knowledge testing OSH (Occupational Safety and Health Certificate) is a document confirming that employees have received the required amount of information in this area.

Along with knowledge in their specialty, undergoing all necessary types of instruction (introductory, on-the-job, etc.), internship in their profession, employees of an enterprise/organization must have a certificate indicating that they have knowledge of labor protection, in accordance with developed program. This requirement is put forward by the Labor Code.

A certificate of testing knowledge of labor protection requirements (Certificate of labor protection) is issued to an employee of an organization who has completed training in labor protection and testing of knowledge of labor protection requirements. The certificate of testing knowledge of labor protection requirements also contains information about additional (repeated) tests of knowledge of labor protection requirements.

Unscheduled inspections are carried out in case of changes (additions) in legislation, before the start of using new equipment at the enterprise, when changing activities (positions), at the request of regulatory organizations, if the employee had a break in work for more than one year, after accidents or major accidents cases.

The inspection is carried out by a commission of 3 people, employees of the enterprise, who, in turn, have already been trained and tested their knowledge of labor protection requirements and have a certificate of testing their knowledge of labor protection requirements. Representatives of trade unions and teachers of organizations whose activities include teaching labor safety rules are also allowed to be members of the commission.

Issuance of labor protection certificates



According to existing standards*, the issuance of occupational safety certificates is carried out directly by specialized training centers that have a license and accreditation in the field of occupational safety and health (Article 217**, clause 2.3.2*) (there is also the option of obtaining it in your organization, but this must being a fairly large organization, creating your own commission is a very labor-intensive task, and discussion is not for this article).

We propose to solve this problem in two ways:

  • 1. Issue a certificate of testing knowledge of labor protection requirements on the job, while the employee can not be interrupted from production duties. The process will take several days. Link to required documents at the beginning of the article. BUT! This option is suitable ONLY for specialists who have been trained previously and have considerable experience behind them. For beginners, we recommend the second option.
  • 2. With a direct visit to the training center. The process is long (40 hours - about a month), but the specialist will receive all the necessary knowledge that he may need during the work.
    Upon completion of training, he will pass an exam (in the form of a test), receive a certificate, and will be able to begin performing his immediate duties.

Validity period of the labor protection certificate



The deadline established for a certificate (crust) on labor protection is prescribed in Resolution 1/29 * (the main standard on the basis of which the article was written). Specialists must confirm their qualifications at least once every 3 years (clause 2.3.1*).

But there are nuances - a representative of the regulatory authorities has the right to demand a second inspection, regardless of the deadline (even if the employee received the documents yesterday), so it is still recommended to know the theory.

When is an emergency inspection required?

Regular checks are discussed in more detail in paragraph 3.3*.
  • 1. When regulations, legislative norms, or other standards change;
  • 2. When changing technical processes, operating new equipment, in other cases when workers are required to obtain additional knowledge to ensure safe work;
  • 3. Appointment of a specialist to a new position;
  • 4. At the request of the inspector (if violations, accidents, etc. are detected);
  • 5. A break from work for more than a year.
In addition, when moving from one organization to another, the certificate loses its validity and must be reissued. The employer must take care of obtaining this document for a newly hired employee within a month after hiring (clause 2.3.1*).

What is a certificate (certification) for labor protection



And now a little theory.

A certificate is nothing more than a document confirming that the holder has the right to a particular type of activity (in common parlance, a “crust”).

Labor protection is a set of measures aimed at providing the organization with safe working conditions.

It follows that a labor safety certificate is a document confirming that the owner can (has the right) to take a direct part in ensuring the safety of his enterprise.

According to clause 1.5*, all management personnel must be certified in this area. Of course, in practice they usually don’t do this, but the person responsible for labor protection and the manager are required to receive this document (if there is no person responsible in the organization, then the head of the enterprise takes responsibility, clause 1.7 *).

This document is issued by specialized educational institutions that are licensed and accredited in this field.
Training programs are developed and approved by the Ministry of Labor and Social Development of the Russian Federation in agreement with the Ministry of Education of the Russian Federation.
The head of the enterprise is responsible for the correct and timely execution of certificates for his specialists (clause 1.7*).

Workers are often interested in how they can check their occupational safety certificate.

This is a strange question for us, for one simple reason - if it arose, then where did you receive it? Of course, there are now a lot of dubious organizations in this area, and the prices sometimes do not correspond to reality (which is also important to pay attention to), and these people can be understood from a human perspective.

As is customary in our 21st century, training centers do not post information about passing certification (although in vain), you have to check it the old fashioned way. If you don’t like OUR offer, then below are several aspects that you need to pay attention to.

  • 1. Any employer has the right to send a request to an educational institution about certification by an employee, and he is obliged to respond as soon as possible (some, like ours, for example, even confirm by phone);
  • 2. Upon receipt of the document, the employee has the right to request an extract from the protocol (the protocol itself is stored in the archive) and a copy of the license of the educational institution (if this is an electrical safety permit, then they are required to provide a knowledge test log with the endorsement of a Rossnadzor inspector), and a copy of the license;

You need to issue occupational safety certificates:

  • heads of companies and their structural divisions;
  • individual entrepreneurs;
  • managers of all types of work;
  • OT specialists;
  • employees performing hazardous work (for example, welding, operation of pressure vessels);
  • representatives of labor collectives on occupational safety issues;
  • persons responsible for various areas of occupational safety in departments.

Who issues occupational safety certificates?

The occupational safety certificate is issued by the organization that organized the training. It could be:

  • commission of a licensed training center;
  • the organization's own commission. It must include at least 3 engineers who have been trained (usually at a training center) in a given course or type of work, with valid certificates for testing knowledge of labor protection requirements.

It is often more profitable and easier for small businesses and individual entrepreneurs to attend a training center and obtain a certificate in occupational safety and health (buy a course) than to organize such training on their own, including creating their own examination committee. The standard validity period of a labor protection certificate is three years or more, provided that after three years retraining is completed.

How to obtain a certificate of testing knowledge of labor protection requirements?

It is impossible to buy a labor safety certificate, because ID numbers are registered with the territorial labor department. A new 2019 occupational safety certificate is issued only after either at the enterprise itself or after successfully passing the exam. The training is short-term and takes approximately 1-3 days.

IN place with a labor safety certificate, the worker receives a knowledge test report or its certified copy. This document must be carefully stored. It will come in handy if the occupational safety certificate gets lost or dirty. By presenting it to the employees of the organization that conducted the training, you can easily obtain a duplicate certificate. Otherwise, you will either have to search for a long time for your name in the training protocols, which are stored in the archives of the examination commission, or undergo training again.

Validity period of the labor protection certificate

Typically, the validity period of a labor protection certificate is 3 years or more until the re-inspection marks run out.

This is because the employee must pass every 3 years.

When this period of 3 years ends, you need to undergo training and take exams again. After a successful knowledge test, a new entry is made into the certificate, and the worker is given a corresponding copy of the protocol (or a copy thereof). Training should begin not after the expiration of the labor protection certificate, but in advance, so as not to deprive the worker of the opportunity to work.

The certificate of a labor protection specialist or employee must be renewed earlier than after 3 years if:

  • the requirements of the Labor Safety Rules and other regulations on which training was conducted have changed;
  • if an injury or accident occurred on the site, and the responsible persons were sent for retraining;
  • During an extraordinary knowledge test, the worker showed an unsatisfactory level of knowledge. In this case, the certificate is confiscated and the employee is sent for retraining.

How to correctly fill out a certificate of testing knowledge of labor protection requirements?

All records are made by the responsible person of the organization that conducted the training. It is advisable that he have legible handwriting. Since there is no uniform procedure for filling out a certificate of testing knowledge of labor protection requirements, you must strictly follow the instructions printed under the lines of the sample document. So, when filling out the left side of the occupational safety certificate, enter:

  • full name of the organization that provided the training;
  • ID number;
  • Full name, place of work, position of the worker;
  • the name of the program in which the worker studied and the number of training hours spent;
  • protocol details;
  • current date.

After the chairman of the commission signs the occupational safety certificate, affix a stamp.

Before issuing a completed certificate of testing knowledge of labor protection requirements to a trained worker, make an appropriate entry in the certificate registration log maintained in your organization.

If the training is repeated, then the left side of the certificate is already filled out. In this case, you should fill in the right side. The procedure is the same, only the name of the organization that conducted the training and the certificate number do not need to be written. If the knowledge test was not carried out by the organization that issued the certificate, you can try to write its name in the line designated for the name of the training program. It is necessary to put a stamp every time.

After repeated knowledge tests, there is no need to re-register the document in the certificate issuance journal. If there is a need to record the renewal of certificates, you can create a separate free-form journal.

OTHER QUESTIONS

Is a certificate of occupational safety specialist issued by one organization valid in another organization?

Employees of different departments of GIT answer this question differently. The general approach to resolving this issue is given in paragraph 3.3 of Resolution 1/29. This paragraph talks about the fact that if, when transferring a worker to another job or assigning him to a position, he needs additional knowledge on occupational safety, then before starting work, he needs to be retrained.

For example, if an occupational safety specialist left one scrap metal processing organization and got a job with competitors with similar types of work, then in light of clause 3.3 he does not need to be retrained. And if, after being fired, he got a job in a kindergarten, then the old certificate is not suitable - he will have to go through the process again to get a new occupational safety certificate.

If possible, it is worth finding out the point of view of the labor inspector who supervises your organization on this issue. If this is not possible, but doubts remain, it is better to go through the training again. There is no such thing as too much useful information!

Occupational safety certificate: buy or undergo full training?

Some organizations offer to buy a new 2019 occupational safety certificate without classes or exams. Resist the temptation to “make your life easier” in this way, because if you don’t know the safety rules, you can be seriously injured or killed.

Knowing the requirements of legal regulations on occupational safety is important not only for workers involved in hazardous work, but also for top managers of companies. This will help not only ensure personal safety, but also protect your organization from fines, unreasonable demands from employees of inspection bodies, accidents, breakdowns, and other unwanted incidents.

How should I store the certificate of knowledge testing of labor protection requirements?

The ID must be carried with you at all times, not laminated or covered with other films, because this will prevent subsequent entries from being made. If the inspector finds that the worker does not have the appropriate identification with him, he must remove him from work.

When do you need to change your certificate of knowledge testing of labor protection requirements?

Identification cards have to be changed periodically. This is done if:

  • The certificate has run out of blank pages. After the next knowledge test, entries are made on a new form.
  • The employee or employee has changed his/her last name. A new certificate is issued during the next training and is issued after successfully passing the exam. Until this point, it is enough for the employee or employee to present a copy of the marriage certificate to the inspectors.
  • New regulations came into force, which approve new samples of occupational safety certificates. In this case, a period must be specified during which appropriate training and replacement of certificates must be carried out.
  • The certificate has become unusable: wet, dirty, torn, burnt, etc. In this case, the worker is routinely issued a duplicate certificate.
  • The worker changed his position, moved to work for another organization. In this case, he needs to undergo retraining, and a new certificate will be issued, indicating his new details. This must be done because new responsibilities will require additional OT knowledge. It often seems that if a worker moves to work from one company to another for a similar position, then there is no need for additional training. Most often this is not the case. For example, the specifics of the work of occupational safety specialists at a dairy and cement plant, in a hospital and in a motor transport enterprise differ significantly.

Should occupational safety certificates be changed if the organization has changed its name, but the nature and specifics of the work remain the same?

If the new organization is the legal successor of the previous one, the identity card does not need to be changed. Information regarding legal succession is contained in the Charter of the new organization and should simply be made available to the units. Otherwise, workers will have to be re-trained and given new certificates, since they are considered newly admitted to the organization and are therefore required to undergo training.

Does having a labor safety certificate exempt you from undergoing labor safety training?

The certificate is a pass to perform work, but not a multi-passport. If you have a certificate, even a labor protection specialist, the worker will still have to undergo all types of instructions and internships.

Exceptions are process safety specialists, occupational safety specialists, teachers, employees of federal and executive authorities with continuous work experience in occupational safety and health for 5 years or more. They are allowed to study, take exams and receive appropriate certificates (or renew them) one year after employment.

According to the law, the employer is obliged not only to provide employees with safe working conditions, but also to provide training on labor protection and test the acquired knowledge. Confirmation of the acquired knowledge of workers will be a certificate of testing knowledge of labor protection requirements. But let's deal with everything in order.

Occupational safety training

The procedure for training in labor protection was approved by Resolution of the Ministry of Labor of Russia/Ministry of Education of Russia dated January 13, 2003 No. 1/29. According to the procedure, labor safety training is mandatory for all company employees, including company managers.

Certain categories of workers must be trained and tested in special training programs directly at the enterprise itself or in an educational institution, training center and other organizations that have a license allowing them to carry out educational activities. Such employees include, in particular, company managers and specialists who deal with occupational safety issues at the enterprise.

Other employees of the company have the right to receive knowledge and confirm its availability in the organization itself. The fact that the employee has passed the exam and has all the necessary knowledge is confirmed by the issued certificate of knowledge testing on labor protection. In order to take exams on knowledge of labor protection, a special commission consisting of at least three people is created from among the workers who studied directly at the training centers.

An “exam” is then administered to ensure that employees have mastered the knowledge gained. The knowledge test is carried out in a form determined by the employer. An occupational safety certificate is issued to employees who have completed training and “passed the exam” on their knowledge of occupational safety. In this case, it does not matter in what form the exam was taken - the employer has the right to establish the chosen form in a local regulatory act. Most often, an oral exam is used using pre-approved tickets or testing using special software.

The form of the certificate is given in Appendix No. 2 to the Procedure, approved. Resolution of the Ministry of Labor of Russia No. 1, Ministry of Education of Russia No. 29 of January 13, 2003

The labor safety certificate form for workers contains the following information:

  • Full name of the company indicating the form of ownership;
  • Full name of the employee to whom the certificate was issued (full name);
  • The place where the employee works;
  • The position in which the employee works;
  • The name of the training program that the employee completed;
  • Duration of training completed;
  • Number of the minutes of the meeting of the knowledge testing commission;
  • The date when the protocol was drawn up;
  • Signature and transcript of the signature of the chairman of the training commission;
  • Stamp (if available).

The question often arises about the presence of a stamp on the ID. Meanwhile, if a company or individual entrepreneur does not have a seal, then its absence on the certificate should not raise questions.

Validity period of the labor protection certificate

Managers and individual company specialists must confirm their knowledge of labor protection at least every three years. Thus, if we talk about the validity period of a labor protection certificate, it turns out that the maximum validity period of the document is 3 years. But if certain situations arise, the period may be shorter. Thus, an extraordinary test of workers’ knowledge of labor protection should be carried out in the following cases:

  • When making changes to legislative acts that contain labor protection requirements. At the same time, it is worth checking the knowledge that relates specifically to these changes;
  • If an employee is transferred to another position or begins to perform new duties that require different knowledge, then before starting to perform new duties he must confirm that he has the necessary knowledge by passing a test;
  • If new equipment is introduced or technological processes change, the employee must confirm that he has the necessary knowledge of labor protection when working, for example, on new equipment;
  • If an emergency or accident occurred at the enterprise, and in addition, if repeated violations of labor protection requirements were discovered;
  • An extraordinary inspection can be carried out at the request of the employer, state supervisory authorities, executive authorities of the constituent entities of the Russian Federation in the field of labor protection, etc.;
  • If the employee takes a break from performing his or her job duties for more than 1 year.

In the cases listed above, a certificate of testing knowledge of labor protection requirements , will have a shorter validity period.

The results of the extraordinary inspection are documented in a protocol in the form contained in Appendix No. 1 to the Procedure approved by Resolution of the Ministry of Labor of Russia No. 1, Ministry of Education of Russia No. 29 of January 13, 2003. Employees who failed the exam (did not pass the labor safety knowledge test) are obliged go through it again within a month.

The employer must take into account that in a situation where an employee does not have a certificate of knowledge testing, that is, he has not been trained and has not proven the presence of the necessary knowledge, but despite this, the employer is allowed to perform labor duties, administrative liability is provided.

According to the labor legislation of the Labor Code of the Russian Federation, Art. 212, enterprises and organizations are obliged to ensure the safety of workers. In order to comply with the Labor Code, enterprises and their employees are legally required to undergo short-term training courses in order to improve competence in the field of labor protection (Resolution 1/29 of the Ministry of Labor), as a proactive measure aimed at reducing the number of accidents, reducing injuries and occupational diseases.

The following categories of personnel are required to obtain a labor safety certificate after completing training:

  • managers, deputy managers, chief specialists, heads of departments and divisions, engineering and technical personnel exercising control and technical supervision of work at workplaces;
  • those responsible for induction and initial training at the workplace;
  • specialists of occupational safety services, personnel charged with organizing the work of occupational safety and health, members of occupational safety commissions;
  • employees of executive authorities and local government;
  • employees of educational institutions and teachers of schools, universities, vocational institutions;
  • members of certification commissions (CHAK).
